By Jackie Stanley Think for a moment about the highest mountain you ever climbed, the deepest valley you ever crossed, or the longest river you ever had to swim. Perhaps it was healing a relationship with an estranged loved one, closing a big deal at work, overcoming an addiction, surviving an illness, succeeding against the odds or making what seemed like an impossible dream come true. I imagine that there were moments in the process when you felt weak, became convinced you could go no further, and wanted to turn back and give up. A few years ago I decided to walk in an 18-mile marathon. At about the 10-milke mark, I hit the proverbial wall. Every muscle in my body ached, and I hurt in places that doctors dont even have names for. I was tempted to sit down in the middle of the road and ask the medics to carry me away on a stretcher. I thought there was no way I could make it to the finish line. But I didnt give in to my negative thoughts. What kept me going? How was I able to summon the strength I needed to forge ahead? I focused my mind on how good I was going to feel when I finished what I started. And I reflected on the other times in my life when I thought I had reached the end of my rope, only to find the strength to tie a knot and move on. I finished the marathon and the experience of almost giving up taught me that the deeper we have to reach inside ourselves to succeed, the greater our sense of accomplishment. Losing weight or living a healthy life is not easy. It may very well be the hardest thing you ever attempt to do. And it may require you to bring for every ounce of your inner strength and personal power. The same wall we encounter during other challenges in life will invariably rear its ugly head in our journey to lose or manage our weight. There will be days when it will seem as if the universe is conspiring to ensure our failure, to force us to give up on the goals we set in January by throwing cold water on our enthusiasm. But dont fall into the enticing trap of negativity. You have the capacity to face the invariable challenges that lie ahead. You have the strength to endure setbacks and disappointments. You have the energy to persevere. You have succeeded in other areas of your life, and you can reach the goal you have set to live a healthier life. Preparing for Your Baby’s Baptism or Christening

By Charlene Hertzberg A Baptism or Christening is a familys way to introduce their child into their church and faith officially during which they are blessed, and thanks is given for the childs safe arrival into the world. However, some parents may choose for it to be a simple naming ceremony rather then a full scale religious one. A naming ceremony is a way to welcome the child without committing the child to the religion. The first thing you must do to prepare for your babys Baptism/Christening is to decide if you will have a religious or secular (non-religious) ceremony. Once you have chosen which type of ceremony you would like to do, you will then need to select a date and contact your church. You will need to meet with your minister, priest, or clergyman to discuss the details of the event. Will you it be held at the church, your home, garden, or another location? Find out about the guidelines for the ceremony, will it be something that is performed during a regular Sunday service or is it something that is done on a separate day and time that you need to schedule. If your church requires it, you may have to take special classes before the Baptism/Christening takes place. Dont forget to ask questions about the procedures you need to follow during the actual service, as well as the use of things like video and photography during the event. Finding out about these things ahead of time can be helpful when sending out invitations to your guests because you are able to make them aware of the rules they must follow during the ceremony, for example: no video cameras or flash allowed inside the church. Once you have set your date and determined the information you will need to communicate it to your guests, it is time to send out invitations. It is best to begin looking for invitations about 1 month before the ceremony. You will need time to get them made up and to get them out to your guests. Guests should receive them at least two weeks prior to the big day. For many people, this will mean that you need to choose your invitations before the baby is born. The most important part of the entire event will be selecting your babys Godparents, should you choose to have them. The Godparents will be the people who will take care of your child if something were to happen to you and your spouse, so making a hasty decision is not a good idea. Religiously speaking, theyre also responsible for directing your child in the customs of your religion. Traditionally, in many religions, baby girls are given two Godmothers and one Godfather, and baby boys should have two Godfathers and one Godmother, but its really up to the parents to decide how many they want. You will also want to take into consideration how the chosen Godparents may handle the responsibility of becoming your childs full-time guardian should the need arise. Once you have made the all important decision of choosing the Godparents, the rest of the event will be a breeze. Traditionally, the Baptism/Christening gown that your baby will wear during the service would be a long white or cream gown, worn by both girls and boys. Many families will have a gown that has been passed to them from other generations, but if you do not have a gown you can choose to buy a vintage gown from an antique store, or purchase a new one. If you are not sure about having your baby boy wear a gown, do not be concerned, in recent years it has become quite common for baby boys to wear formal short suits or a formal white shirt and pants. If you are planning to buy a new outfit, you may want to find out how to preserve it for use by future generations. The actual service will only last for about 20 or 30 minutes, and then you may elect to hold a small reception afterwards. If you do plan to have a reception, you will need to decide where youre going to have it because you may need to book the venue in advance if you want to use a restaurant or hall. The food doesnt need to be extravagant, it can be as simple as sandwiches, vegetable and fruit trays, and drinks, or you can choose to have a hot meal catered. If youre going to do the food yourself, prepare as much as you can the night before and store it at your chosen venue and then talk to family members about helping you set everything up. If money is an issue, consider holding a potluck. Youre family and friends will be more then happy to bring their favorite dish and you can be sure that there will be plenty of food, without the added financial stress. Whether opting for a reception or not, it is a good idea to pick up a small favor for your guests. These can be any small gift that your guests will appreciate, and can be given at either the ceremony, the reception, or both. Your guests will appreciate your etiquette and your thoughtfulness. In some communities, it is also common to give a small gift to the godparents. Once your babys special day is complete, dont forget to send thank-you cards or letters to all your guests to show your appreciation for coming to your childs Baptism/Christening. For those family members and friends who were unable to attend the event, whether due to distance or other obligations, you may want to consider sending them a Baptism/Christening announcement as a way to share your day and provide them with a keepsake. Status of Punitive Damage Law

By Patrick Madden RECENT CASE LAW AFFECTING PUNITIVE DAMAGES A series of recent United States Supreme Court decisions have defined the standard for imposition of punitive damages. In State Farm Mutual Insurance Company v. Campbell, 538 U.S. 408 (2003), the Supreme Court applied the guidepost it had previously established in BMW of North America, Inc. v. Gore, 517 U.S. 559 (1996). The Gore decision directed appellate courts reviewing punitive damages awards to consider the following three factors: (1) the degree of reprehensibility of the defendants misconduct; (2) the relationship between the actual and potential harm suffered by the plaintiff and the punitive damages award; and (3) the difference between the punitive damages awarded by the jury and the civil penalties authorized or imposed in comparable cases. In State Farm, the Supreme Court emphasized that, of the three Gore factors, the single most important indicator of the reasonableness of the punitive damage award is the degree of reprehensibility of the defendants conduct. The Supreme Court then applied the five factors it had previously set forth in Gore to measure the reprehensibility of the defendants conduct: whether the harm was physical or economic; whether the tortuous conduct evinced an indifference to or reckless disregard for the health or safety of others; whether the conduct involved repeated actions or was an isolated incident; and whether the harm resulted from intentional malice, trickery, or deceit, or mere accident. The United States Supreme Court heard oral arguments in Phillip Morris v. Williams, Number 05-1256, on October 31, 2006. In Phillip Morris, the Supreme Court will, for the first time, be asked to apply the Gore guideposts to a case involving the death of a plaintiff - a long time smoker who died of lung cancer - rather than a case of merely economic damages. In Phillip Morris, the Oregon Supreme Court upheld the punitive damage award to the family of a deceased smoker more than one hundred times the amount of actual damages. Phillip Morris appeal presents two questions to the court: (1) whether, in reviewing a jurys award of punitive damages, an appellate courts conclusion that a defendants conduct was highly reprehensible and analogous to crime can override the Constitutions requirement that punitive damages be reasonably related to the harm to the plaintiff; and (2) whether due process permits a jury to punish the defendant for the effect of its conduct on non-parties. DEFENDING A COMPANY IN PUNITIVE DAMAGES CASE Punitive damages often represent a significant, if not the most significant, exposure a company faces in litigation. Dealing with punitive damages must be part of a bigger litigation strategy. It is critical that a company, in conjunction with trial counsel, prepare a comprehensive plan of action to avoid, or minimize, the companys exposure to punitive damages. The plan of action should include discovery and witness selection intended to demonstrate the difference between any mistakes which were made, and conduct which was intended to cause harm. At trial, effort must be made to select jurors who will rationally analyze the evidence, rather than base their findings exclusively on anger or sympathy, to allow a chance for a positive outcome for the company. INSURABILITY OF PUNITIVE DAMAGES There is currently no clear guidance from either the Texas Legislature or the Texas Supreme Court on the issue of whether Texas public policy prohibits a liability insurance provider from indemnifying an award for punitive damages imposed on its insured because of gross negligence. Texas appellate courts have long wrestled with the issue, and have reached different conclusions. Some courts have found that parties should be allowed to enter into contracts freely, and ensure that the insurers comply with their contractual obligations. See Am. Intern. Specialty Ins. Co. v. Triton Energy, Ltd., 52 SW.3d 337 (Tex. App. - Dallas, 2001). Other court have found that insuring punitive damages violates public policy, as it defeats the purpose of awarding punitive damages (to punish the wrongdoer and to deter similar behavior in the future), by permitting the wrongdoer to shift the burden of paying the punitive damages to its insurer. See Milligan v. State Farm Mut. Auto. Ins. Co., 940 SW.2d 228 (Tex. App. - Houston, 1997). The Texas Supreme Court has thus far refused to address the issue of whether punitive damages are insurable. However, the Fifth Circuit Court of Appeals has certified questions concerning punitive damage awards to the Supreme Court of Texas, in a case filed in August 2004, which is currently pending before the Texas Supreme Court. Irritation

By Prasenjit Kamble What irritates you?, asked she. I looked at her with a look of bewilderment, unable to fathom her question and gauze my correct response. Yes. What irritates me? I dont know. There are many things that irritate me, the most important being, being misunderstood. By misunderstood I mean both wrongly understood as well as not understood. I say a flower and the other person thinks a rose. That irritates me. I want to do something and my self-determinism is inhibited. That irritates me. I dont want to do something and yet I am forced to do it. That irritates me. There are n numbers of things that irritate me. Some at some times, others at all times. I get pissed off and boggle down the scale to the level of apathy. Over there I am in the state of I dont know. I lose my ability to understand why things are happening the way they are. I start doubting myself. Blame the other person, blame myself, think of myself as worthlessuntil I finally find out that I am leading towards a state of no-conclusiona bottomless pit. Nothing works our. Nothing has ever worked out. I become clueless and then I decide to drop the clues; I decide to drop all my efforts. But to me they are clinging so stubbornly that it becomes difficultnearly impossible to drop them. The more I try, the more tightly they cling. I get agitated, start cursing, hitting down things and find myself unworthy of living. I think of suicide. Try to locate things which could take me closer to death, but usually find none. Everything that otherwise would have been enough to separate me from life, at that moment, seems to be worthless. Hanging between life and death, I do not realize. I do not recognize. I just am an agitation, no meaning, no search, no goals. A friend calls me. Initially I refuse to talk. But then the cell keeps on ringing. So finally switch it off. Then restart it after some time. Again he calls. Reluctantly I say Hello. He immediately realizes that I am not okay, that something is amiss. He asks me, but I have no reason, no cause to tell him. I dont know it myself. He persists. I shout at him. That doesnt work. He asks me again. I ask him to shut-up. He hangs-up the phone telling me that he will call me again in sometime. I decide to switch off the phone, but dont. A few moments later, I find myself waiting for his call. He doesnt. My mind rushes, Is he angry? Why did I shout at him? I feel like I must call him and apologize, but find myself unable to do it. My agitation is replaced by a sense of helplessness and guilt. I find myself useless and helpless. Again I am back to a state of not-knowing, but this time, the intensity is reverse. Theres something in me that is releasing. The guilt has overtaken everything else and I start looking for possible hideouts. I find a good one in attacking. I blame the friend for all his past wrongs. I tell myself that he deserved to be shouted for all the mistakes he has done, for all the bad things he has done to me. But that doesnt work. Again I find myself helpless. I call him and ask for help. I need you. I need your help in getting out of this, I say. But within I know this is just a way I am trying to cover my guilt of hurting himthe principle of reverse positivity. He shows as if it has worked. He is ready to help me, but I am not convinced of his motives. His past keeps on ringing in my ears and occasionally sends my faith for a toss. But again and again I find myself asking him for his help. By feeling myself weak, I am just making him feel strong and desiredjust an attempt to foster his ego and get things even. Somehow this seems to work, but I am unhappy. In between those pleas for help, he keeps on handling me, trying to suggest and I keep on erupting. He is patient. I am not. I start blaming myself for behaving in this strange way with him and also for being unable to handle myself. I dont know whats happening and why its happening. I feel myself being misunderstood and un-understood. I am bewildered and unable to fathom myself. I am irritated. And I dont know why. Prasenjit Kamble is an emerging author. Marital Communication: Influencing and Persuading Your Spouse

By Shelle Rose Charvet Why does my husband always disagree? Why does my wife put my ideas down? One of the most irritating aspects of life as a united couple is trying to convince your spouse when they take a Macho attitude. Wives say that when they want to suggest an idea to their spouse, or get an agreement that a problem needs to be fixed, they are often faced with denial and negative attitudes. Husbands report that when they want to try something new, their partners often reject their suggestion without proper consideration. And both men and women say that they resent tiptoeing around on eggshells to avoid getting their life partners angry. Some people seem to be constantly negative or skeptical. How can you influence someone who always looks for the crack or the loophole in what you say? Doesnt it seem unfair that it’s often with your life partner that you have the least credibility? What do you have to do to get taken seriously? It can be easier to just give up rather than spend time and energy trying to get people to listen. When a person is running what we call a Macho Pattern, they operate as if they believe the following: They already know everything there is to know. They do not have any problems; they and everything connected with them are perfect. If there are problems, they are of someone else’s making. They are better, higher, more important, and more knowledgeable than anyone else. How many times have you made major decisions to assuage someone’s ego or to prevent them from losing face? Just listen to media interviews. When the interviewer asks if someone were surprised by the turn of events, rarely if ever will the person admit to being surprised. That would be saying that they did not already know everything there is to know. Once I sold a sales training program with optional follow-up coaching. No one took up the coaching offer because that would have meant conceding they needed help. Now the coaching is just part of the training program. All of us have the tendency to become Macho at times. Notice your reaction when one of your parents tells you what to do! To make sure that even your spouse will consider your ideas, you could use this Macho Test as an editing technique. Is it anywhere stated or implied that? There is something they don’t already know, I am telling them what to do, They have a problem and I have the solution, They are not perfect in some way, and/or I am better than they are in some way. If any of the above are stated or implied, it does not pass the Macho Test! You may wish to rephrase as follows: As you probably knowThen state the thing you suspect they do not know Use the language of suggestion: You may wish to consider I understand that other couples have had this issue and what some of them have done is How have you solved this problem? (This implies they have already solved all the problems) With your experience and knowledge in this area. Your role is. My role is (This lets you establish different yet equal roles) Next time when you sense if you present a ‘new’ idea, your spouse will deny it’s actually new, try suggesting that it may be something they have already considered. You probably already know exactly who all the Machos are in your life. Once rephrase your thoughts to pass the Macho Test, your spousal partner may become more willing to participate in the free flow of ideas.
